Terms and Conditions for Concept 360 Limited
Definitions
• “Contractor”: Concept 360 Limited, its directors, employees, agents, or subcontractors.
• “Client”: The individual or organization contracting the services of Concept 360 Limited.
1. Quotations
Our quotations are produced with as much detail as possible to avoid misunderstandings. If something is missing that the client would like included, they should inform the contractor accordingly. Any additional work found necessary will be agreed upon with the client and a separate revised or extra contract quotation will be provided.
2. Working arrangements
All prices quoted are based on free access and unimpeded working during normal business hours (7:30am to 5pm Monday to Friday) unless otherwise agreed upon. Both the contractor and the client will agree on practical arrangements that minimize disruption to the client and allow the work to be completed efficiently. Free access is required for the delivery of materials, plant, machinery, and skips.
3. Material ownership
All materials provided by the contractor or their subcontractors remain the property of Concept 360 Limited until full and final payment is received via bank transfer or check. Access to and collection of unused or used materials, equipment, and plant remains in place until full and cleared final payment is received.
4. Contract activation
Accepting a quotation, either verbally or in writing, and commencement of work will activate these terms and conditions.
5. Subcontractors
The contractor may employ both direct and subcontract labour to work on site. Each individual contractor is responsible for their own third party liability. The contractor will oversee all work to completion and takes full responsibility for the general and operational management of any contract agreed upon with the client.
6. Payment
Payment can be made via bank transfer or check. A receipt for payment will be provided upon request. Payment in full is due within 7 days of an invoice being raised. A down payment may be requested if the acquisition of bespoke or high value materials is necessary.
7. Insurance and liability
Public liability insurance is provided up to the sum of £5,000,000 by Islands Insurance, policy number 7997040A. All usual general building practices are covered within our insurance policy.
8. Confidentiality
All client information is retained in accordance with the Data Protection (Bailiwick of Guernsey) Law 2017 and all personal and other client details will remain confidential.
9. Timeframes
All timeframes given are assuming un-impeded access and scheduling of work. Timescales are estimated and dependent on material and labour availability. Exterior work, particularly painting and decorating, may be delayed by wet or extreme weather conditions, shipping, and material availability.
10. Marketing
During each project, Concept 360 Limited may take photographs of the various stages of the job. These may be posted on their website or social media pages for marketing purposes. The client should inform the contractor in advance if they do not wish for the pictures to be used.
11. Variations
In the event of unforeseen difficulties or other circumstantial changes, the quotation price or estimated cost may be revised to reflect the situation at hand.
12. Guarantees
The contractor provides a full guarantee on workmanship for a period of 12 months. Guarantees on materials run in accordance with the manufacturer’s warranty periods where applicable. Our guarantee covers all new work and new materials used in our construction or repairs, but does not guarantee the integrity of any existing structures, materials, or decorations. In the event of a failure beyond the guarantee period, the contractor will be happy to investigate the cause and negotiate a solution with the client.
13. Termination
Either party may terminate the contract at any time by giving written notice to the other party. In the event of termination, the client will be responsible for paying the contractor for any work completed up to the date of termination.
14. Dispute resolution
In the event of a dispute between the contractor and the client, both parties will make every effort to resolve the matter through good faith negotiation and mediation. If a resolution cannot be reached, either party may pursue legal action as necessary.
15. Governing law
These terms and conditions are governed by the laws of Guernsey, Channel Islands.
